What to do after a transport accident?

Publish on October 19, 2023

The impact of a transport accident can last a lifetime and injuries can be both physical and emotional.

In the weeks and months following a transport accident it can be hard to know what to do next – in the article below, Ryan Legal Solicitor Adam Attard shares his top 4 tips for what to do after a transport accident.

1. OBTAIN MEDICAL TREATMENT

You should always seek medical treatment immediately after a transport accident even if you think your injuries are minor.

As many injuries can surface or worsen days or even weeks after a transport accident, it is important that you continue to consult your doctor to report any symptoms that have become apparent after the transport accident.

This will ensure that you receive appropriate treatment and will help to prevent disputes with the TAC in relation to your injuries.

2. COLLECT INFORMATION ABOUT THE ACCIDENT

It is important to collect as much information about the transport accident as soon as possible, including: registration details of all vehicles, contact information of all drivers involved, contact information of any witnesses, photographs of the accident scene, signage, lighting and whether conditions. If you are not in a position to do this due to your injuries, ask a friend or family member.

3. REPORT THE ACCIDENT TO AUTHORITIES

You must report the accident to police, and to the relevant public transport operator if the transport accident involved a train or a tram.

4. SEEK LEGAL ADVICE

Transport accident claims can be complex.

If you have been injured in a transport accident you may be entitled to a range of benefits including;

  • Medical and like expenses including home help services, vehicle modifications and transport expenses
  • Loss of earning and earning capacity benefits
  • Lump sum compensation for permanent impairment
  • Common law damages for pain and suffering and economic loss

It is important to know that strict time limits apply which may preclude you from claiming compensation if they are not complied with.
